One of the basic rules of Universal Credit is that you must not be receiving education.
There are several exceptions to this rule that allow claims by people who are responsible for a child or by young people who are without parental support.
Another exception covers people with disabilities who get PIP or DLA if they have had a Work Capability Assessment and been found to have Limited Capability for Work.
On 5th August 2020 the government changed the rules to limit this exception.
From that date onwards you can only use this rule to claim while you are receiving education if the work capability decision was made before you claimed Universal Credit; or if you were already on Universal Credit, before you started your course.
There is a convoluted way around this restriction by making a credits-only claim for new-style ESA.
